EcoFallout End User License Agreement (EULA)

1. Limited License: Subject to your agreement with both this End User License Agreement (hereafter referred to as the “EULA”), and the EcoFallout Game Rules, PYN Games grants you a limited, non-exclusive, license that will grant you access to play EcoFallout (“the Game”) using ecofallout.com or ecofallout.info (“the Websites”). PYN Games provides the Game “as-is” with no warranties or guarantees. Access and use of the Game and the Website is only allowed in accordance with the terms and conditions outlined in this EULA and in the EcoFallout Game Rules.
2. Ownership & Rights: EcoFallout and all content included on ecofallout.com and ecofallout.info including, but not limited to, computer code, images, items, concepts, and data is the property of PYN Games and is protected by intellectual property rights laws. Virtual items, including currency are owned by PYN Games, and available for your use through your limited license to play the Game.
3. Changes to EcoFallout: Updates are an integral part of the Game, and from time to time servers will be closed and updates will be applied. PYN Games may at any time revise, update, or otherwise alter the code or data of the Game at their sole discretion. PYN Games also reserves the right to discontinue services at any time.
4. Limited Warranty: The Game is provided “as-is” with no warranty of any kind. The user assumes all risk of playing the Game and using the Website.
5. Limitation of Liability & Indemnification: PYN Games, its employees, and owners shall in no event be responsible to you for any damages, loss or expenses arising from playing the Game or using the Website. You acknowledge that to the extent allowable under applicable law, PYN Games will not be held liable for any loss of data, server downtime, unauthorized use, or any other problems, damages, or loss that may arise from playing the game or using of the Website.
6. Terms & Conditions: You agree to grant PYN Games the sole discretion to enforce both the EULA and the EcoFallout Game Rules. Breaching either the EULA or the EcoFallout Game Rules will lead to disciplinary action against all involved accounts that may include, but is not limited to, the freezing or permanent banning of said accounts.
7. Governing Law: This EULA shall be governed by, and will be construed and enforced according to the Laws of the United States of America, and the laws of the State of Georgia. The use of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
8. Agreement: This EULA supersedes all prior agreements, oral or written. If for any reason a provision of this EULA is not able to be enforced, the provision may be removed and the remainder of the Agreement will remain in effect.
9. Modification: By accepting this EULA you agree that PYN Games has the right to modify or update this EULA at any time. Notice will be provided on the EcoFallout website, and you should periodically check the website for such changes. If you do not accept changes made to this agreement, your only remedy is to terminate your account and cease all activities with said account.
